Driver Agreement

Last updated: 31 May 2026 · Version 1.0 · Applies to every Driver who downloads, signs into, or uses the WasteLinks Driver App.

Please read carefully. WasteLinks Ltd (“WasteLinks”) operates the marketplace platform. You are not employed by WasteLinks. The Vendor that invited you to the Platform (your “Vendor”) is your employer or engager for the purposes of PAYE, National Insurance, holiday pay, sick pay, IR35, workplace discipline, and termination of your work.

This Driver Agreement governs only your use of the WasteLinks Driver App and any data we hold about you in that capacity. It does not vary, replace or interfere with your contract of employment / engagement with your Vendor.

1. Acceptance

By signing in to the WasteLinks Driver App you confirm you have read, understood and agree to this Driver Agreement, together with our Terms & Conditions, Privacy Policy, Driver Location Tracking Disclosure and Acceptable Use Policy. If you do not agree, do not sign in.

2. Driver Eligibility

To use the Driver App you must, throughout your time as a Driver on the Platform:

  • be at least 18 years old;
  • have the right to work in the United Kingdom and be able to evidence it to your Vendor in line with the Immigration, Asylum and Nationality Act 2006;
  • hold a current and valid UK or recognised driving licence of the correct category for any vehicle you operate (Category B for vans up to 3.5t; C1 for 3.5–7.5t; C / C+E for goods vehicles over 7.5t), and any Driver Certificate of Professional Competence (Driver CPC) required by the Vehicle Drivers (Certificates of Professional Competence) Regulations 2007;
  • meet the DVLA Group 1 (or, for vocational licences, Group 2) medical standards relevant to the licence you hold, and notify your Vendor and the DVLA of any notifiable condition that arises;
  • where you carry dangerous goods, hold a valid ADR Driver Vocational Training Certificate covering the classes of waste you transport;
  • where you enter construction sites, hold a current and appropriate CSCS card (or recognised equivalent);
  • not be subject to any current driving ban, disqualification or unspent criminal conviction that would make it unlawful or inappropriate for you to perform the role.

It is your responsibility to inform your Vendor and to stop using the App immediately if you cease to meet any of these criteria (for example if your licence is suspended). WasteLinks may suspend your account from the Platform pending evidence that you again meet the criteria.

3. App Account and Sign-In

You will receive an invitation from your Vendor to register on the Driver App. You must keep your sign-in credentials confidential and must not share your account with any other person. If your Vendor terminates your engagement, your access will be revoked automatically.

You may optionally enable biometric (Face ID / Touch ID) sign-in. If you do, your email and password are stored only in your phone’s Keychain / Keystore, protected by the biometric set that is enrolled on your device at the time of enrolment. You are responsible for ensuring no additional fingerprint or face has been enrolled by anyone else. See our Privacy Policy for more.

4. GPS Location Tracking — Your Consent

When you start a job in the App (status: en route or on site), the App transmits your real-time GPS location to WasteLinks and, through us, to (a) the Customer whose Booking you are fulfilling — for the live arrival ETA only, and (b) your Vendor’s admin dashboard — for operational oversight. Location is no longer transmitted once you complete or cancel the job.

Your consent is required and is freely given. You may refuse or withdraw consent in your iOS / Android settings at any time, but the App requires location permission to be granted while a job is active in order to start or complete that job. Withdrawing consent will not in itself be grounds for dismissal by your Vendor, but may mean you cannot perform Platform jobs. Full detail is set out in the Driver Location Tracking Disclosure.

WasteLinks does not track you outside active jobs, does not use the data for performance scoring without your Vendor’s notice, and does not sell or share location data with any third party other than the parties described above.

5. Photographs, Signatures and Job Evidence

Where the Booking requires photographic evidence (waste loaded, container in situ, hazardous-waste seal, &c.), you must capture clear and accurate photographs using the in-App camera flow. By using the camera in the App you confirm you have, where required, the Customer’s permission to take photographs of their premises.

You must collect the Customer’s signature on the digital Waste Transfer Note (or Hazardous Waste Consignment Note where applicable) before leaving site, and your own signature confirming the waste description, EWC code and load weight are accurate to the best of your knowledge.

6. Driver Conduct

While performing a Booking through the App, you must:

  • drive lawfully and courteously, observing the Highway Code and your Vendor’s safe-driving policy;
  • wear the personal protective equipment (PPE) appropriate to the waste being collected and the site you are entering;
  • follow your Vendor’s safe systems of work (manual handling, lone-working, COSHH, hazardous-substance handling) under the Health and Safety at Work etc. Act 1974;
  • treat Customers, members of the public and other Drivers respectfully, without discrimination on any protected characteristic under the Equality Act 2010;
  • not accept cash, tips, gifts or any off-platform payment from a Customer for waste-collection work facilitated through WasteLinks;
  • not solicit any Customer to engage you or your Vendor outside the Platform;
  • collect only the waste described in the Booking and refuse any waste you cannot lawfully carry under your Vendor’s waste-carrier registration tier; if in doubt, contact your Vendor before loading;
  • under no circumstances tip, deposit, burn, abandon or otherwise dispose of waste anywhere other than the destination instructed by your Vendor. Fly-tipping is a criminal offence under section 33 of the Environmental Protection Act 1990 carrying an unlimited fine and up to five (5) years’ imprisonment;
  • not mix waste streams except where the Vendor and the receiving site explicitly permit it; segregation duties under Regulation 13 of the Waste (England and Wales) Regulations 2011 apply;
  • comply with Drivers’ Hours and tachograph rules where applicable, and never drive while tired, under the influence of alcohol or drugs, or otherwise unfit;
  • report any accident, near-miss, spillage, public complaint or property damage to your Vendor immediately, in addition to any reporting obligation under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013 (RIDDOR).

7. Use of Customer Personal Data

Through the App you may see Customer information necessary to perform the Booking (name, collection address, contact telephone, on-site notes). You agree to:

  • access this data only for the purpose of completing the assigned Booking;
  • not photograph, screenshot, copy, share or retain Customer data outside the App;
  • not contact a Customer for any purpose other than the Booking (e.g. you may call to confirm arrival; you may not later contact them for off-platform work or marketing);
  • treat all Customer information as confidential.

If you become aware of any actual or suspected loss, theft, unauthorised disclosure or compromise of Customer data on or through your device, notify your Vendor and WasteLinks at security@wastelinks.co.uk within twenty-four (24) hours.

8. Whistleblowing — Speaking Up Safely

If you reasonably believe a Vendor (including your own), another Driver, a Customer or anyone on the Platform is engaged in unlawful conduct — including fly-tipping, falsifying a Waste Transfer Note, paying or accepting bribes, modern slavery, or environmental damage — you are encouraged to report it confidentially to whistleblowing@wastelinks.co.uk. Disclosures meeting the conditions of the Public Interest Disclosure Act 1998 are protected; we will not retaliate, and we will not disclose your identity to your Vendor without your consent except where required by law.

9. Personal Data We Hold About You

WasteLinks acts as a data controller for the limited data we hold about you in your capacity as a Driver on the Platform: your name, contact details, sign-in metadata, App activity, GPS location during active jobs, and any signatures you give on Waste Transfer Notes. The lawful basis is a mixture of contract (operating the Driver tools) and your separate consent for GPS tracking. Retention follows our Data Retention Policy.

You retain all your UK GDPR rights — access, rectification, erasure (subject to records we must keep under environmental law), restriction, portability and objection — exercisable by emailing privacy@wastelinks.co.uk.

10. Suspension From the Platform

WasteLinks may suspend or remove your access to the Driver App where we reasonably believe you have: (a) breached this Agreement or the Acceptable Use Policy; (b) endangered a Customer, the public or yourself; (c) committed or been credibly accused of an environmental offence; (d) lost an eligibility requirement at §2; (e) compromised Customer data; or (f) been the subject of a credible regulator request.

Any suspension of you from the Platform by WasteLinks is independent of your contract with your Vendor — your Vendor remains responsible for any disciplinary process and any decision to terminate your employment / engagement.

11. Ending This Agreement

You may end this Agreement at any time by signing out and asking your Vendor or WasteLinks to deactivate your Driver account. Your Vendor may also remove your access when your engagement with them ends. WasteLinks may terminate your access on notice for any of the reasons in §10.

After termination we will retain only the records we are legally obliged to keep (Waste Transfer Notes, audit logs, incident records) per the Data Retention Policy.

12. Liability

WasteLinks is the provider of the Platform only. We are not your employer and accept no liability for your contract of employment / engagement, wages, expenses, training, vehicle, equipment or your Vendor’s acts and omissions. To the maximum extent permitted by law, our total aggregate liability to you under this Agreement is limited to £500, save that nothing in this Agreement excludes or limits liability that cannot lawfully be excluded.

13. Changes to This Agreement

We may update this Agreement from time to time, particularly in response to new safety, environmental or data-protection law. We will notify you in the App on your next sign-in following a material change. Continued use of the App after notification constitutes acceptance.

14. Governing Law

This Agreement is governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
